Chris Hedges challenges NDAA in court

Last week the case against the National Defense Authorization Act was presented to a judge in New York. One of the plaintiffs in the case has decided to sue the Obama administration claiming that by simply doing his job he could be arrested and detained indefinitely due to the nature of his work, reporting. Chris Hedges, columnist for TruthDig, joins us to explain how his day in court went.

The way it works in America is if you want to challenge a law, you need a victim. For example, when they wanted to challenge the anti-abortion law,they needed a pregnant woman (who was named Jane Roe to protect her identity), so it was roe vs wade (county). The same thing with the scopes monkey trial, somebody had to be charged with teaching evolution. I totally agree with getting the NDAA overturned, I just don't know how they can do it with nobody as a victim.

A new bill should be introduced giving the people of the united states of america the power to overturn any piece of legislation, if they can get 1 million registered voters to sign a petition. This would give power back to the people, preventing the Tyranny that we see from the executive branch today. Get Ron Paul and Barney Frank to co-sign on it and send it down the line!

I understand your point, but please don't over-generalize. Many Americans, myself included, are not okay with that fact, are greatly disturbed by the existence of facilities like the one at Guantanamo, and recognize the immense hypocrisy and inhumanity of our government's actions. Right now we are experiencing a pandemic of nationalism in America that has been cultivated by a political fear-machine and are combating it. But, yes: I wouldn't recommend coming here right now.

Check into those mainstream media outlets and see who they are owned by…you will discover why you're not seeing an opposition. Obama also plants his seeds of tyranny under the radar, something he promised he would never do but has been the most secretive president so far.
Also look at history. These same provisions were drawn up under Hitler as well and look what happened there.

I'm not sure he's going to be able to show standing. I've seen cases where the court has said you have standing only if you HAVE or ARE being affected by the law – not merely the hypothetical potential that you COULD be.

The NDAA is an act of paranoic desparation. Obviously our dysfunctional government is beginning to fear the very citizens whose freedoms they are sworn to protect? And now.. who will protect us from our protectors? This law undermines any vestige of trust between the government and the people. Flat out fact is that if it violates our rights as given in the Constitution is it hence forth UNCONSTITUTIONAL…plain and simple…that is why the Constitution exists to begin with!
